Internal Complaints Committee (ICC)

The Internal Complaints Committee (ICC) in colleges is established under the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, commonly known as the POSH Act. The ICC is responsible for addressing complaints of sexual harassment within the institution.

Composition of the ICC (as per the POSH Act)

Presiding Officer: A woman faculty member at a senior level (preferably not below Associate Professor).
At least two faculty members or employees: Committed to women's causes or experienced in social work/legal matters.
One external member: From an NGO or association focused on women’s issues or sexual harassment.
At least one student representative: Preferably from UG, PG, or research level.

Note: The majority of ICC members must be women.

Functions of the ICC

Receive and redress complaints of sexual harassment.
Conduct inquiries as per principles of natural justice.
Recommend disciplinary or corrective actions based on inquiry results.
Conduct awareness/sensitization programs on gender equality and sexual harassment.
Submit annual reports to the institution and statutory authorities.

Key Regulations & Procedures

Definition of Sexual Harassment: Includes unwelcome physical contact, sexually colored remarks, showing pornography, demands for sexual favors, or any other unwelcome conduct of a sexual nature.
Time Limit for Complaint: Complaint should be made within 3 months of the incident, extendable by 3 more months with justification.
Inquiry Process: Inquiry must be completed within 90 days, report submitted in 10 days, and action taken within 60 days.
Confidentiality: Identity of complainant, respondent, and witnesses must remain confidential. Breach of confidentiality attracts penalties.
Penalties for False Complaints: Only if complaint is proven to be malicious with intent. No penalty for complaints made in good faith.

Display Requirements

Prominently display names and contacts of ICC members.
Make the anti-sexual harassment policy accessible.
Provide complaint filing information clearly.

Reporting

ICC must submit an annual report detailing the number of complaints received, actions taken, and awareness activities conducted.
